Affiliate Program Agreement

By filling out the application form you acknowledge that you have read the terms and conditions of this agreement, understand, and agree with them.

1. Joining the Program
By filling out and submitting the Affiliate Program Application form, you are applying to participate in the Multilingualbooks.com Affiliate Program ("the Program"), and agree to be bound by the terms and conditions of this program as stated here. Your participation in the program is solely for the purpose of legally advertising our web site and receiving a commission on products purchased by your referral individuals on a non-exclusive basis. No other purpose is proposed or contemplated.

2 Acceptance And Participation
Upon receipt of your application, we will promptly review it and will notify you of its acceptance or rejection. We may reject your application if we determine (in our sole discretion) that your site is unsuitable for the program.

Unsuitable sites include (but are not limited to) those that: contain unlawful, threatening, defamatory, or otherwise objectionable content; violate or infringe upon intellectual property rights; engage in "spamming" (mass email, mass newsgroup posting, etc...); use inappropriate advertisements (false claims, misleading statements or hyperlinks, etc.)

If we reject your application, you may reapply at a later time. If we accept your application, we reserve the right to terminate your participation if we ever determine (in our sole discretion) that your site or conduct is unsuitable for any reason.

3. Affiliate Links
If you are accepted into the Program, you will be granted access to an area of our site where you may obtain graphics and affiliate links provided by us. You may use the graphics and text provided to you by us, or you may create your own, as long as they are deemed appropriate and conform to our affiliate tracking requirements.

4. Affiliate Tracking
When a web surfer clicks through your affiliate link, a cookie is set in their browser that contains your affiliate username and is set to persist for a period of thirty days. When this person decides to buy a product, our software will look for this cookie to identify the affiliate who will be awarded the commission. Visitors sent through your affiliate link may make a purchase at a later time and the commission will still be awarded if the cookie is present in their browser. It is important to note that you must use the linking information given to you to insure that this cookie is properly set.

5. Commission Calculation
You will earn a commission of ten percent (10%) of the sales price of all orders placed by and paid for by customers who have been identified as having been referred from your site to MultilingualBooks. The commission shall exclude taxes, shipping, sale items, items purchased with a gift certificate, and items purchased at discount due to a loyalty program.

6. Payments
We will pay all commissions that accrue on a bi-monthly basis, within thirty days of the end of the bi-monthly period. If the commissions that accrue total less than $25.00, we will hold the commissions and pay them to you within thirty days after the end of the first month in which accrued but unpaid commissions total $25.00 or more. If a customer receives a refund in whole or in part for any order that resulted in a commission to you, we will deduct that commission from any amount due you.

7. Term of the Agreement
The term of this Agreement shall begin upon your acceptance into the Program and will end when terminated by either party. Either you or we may terminate this Agreement for any reason upon written notice to the other party.

8. Modification of the Agreement
The terms of this Agreement may be modified by us at any time by posting a modified version of this Agreement on our site. If any modification is unacceptable to you, your may terminate your affiliate account. Your continuing participation in the Program will constitute your acceptance of any change.

9. Relationship Of Parties
Our relationship is strictly that of two independent contractors and nothing contained herein will create any other type of relationship. Neither party shall have the right or authority to make offers or create obligations of any type for the other party.

10. Limitation of Liability
We will not be liable for indirect, special, or consequential damages arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Our total liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to you under the Program.

11. Governing Law
This Agreement shall be governed by the laws of the State of Washington By filling out the signup form you acknowledge that you have read the terms and conditions, understand, and agree with them.
